What is Canada’s citizenship policy?

Unusual Circumstances: In some exceptional circumstances, an applicant may be absent from Canada while still maintaining residency for citizenship reasons. The following six criteria are used as a test to determine whether an applicant's absences are within the permissible exceptions:

1.       Was the individual physically present in Canada for a sufficient period of time previous to recent absences that occurred just before the citizenship application? For example, an applicant resided in Canada for three years before departing for a few months. The applicant then returns to Canada to live permanently and applies for citizenship at that time.

2.       What is the address of the applicant's immediate family, dependents (and extended family)? An applicant, for example, leaves Canada for several days each month, but her mother-in-law, husband, and children all remain in the country while she is gone.

3.       Is the pattern of physical presence in Canada indicative of a return to the country or only a visit? An applicant, for example, leaves Canada every month for 7-10 days, but stays in hotels where he conducts business or at the home of someone he is visiting. The applicant always returns to Canada in a house that he or she owns or rents.

4.       How extensive are the bodily absences? It is easier to find presumed residence if an applicant is only a few days short of the 1095 total than if the absences are significant. Example: Despite multiple absences, an applicant was physically present in Canada for the vast portion of the period.

5.       Is the physical absence due to a clearly temporary situation, such as serving as a missionary in another country, pursuing a course of study in another country as a student, accepting temporary employment in another country, or accompanying a spouse who has accepted temporary employment in another country? Exempla: The candidate is granted permanent residency in Canada and is offered a job. Her employer asks her to serve abroad for a year to help oversee a major business initiative when she starts working for him. After the assignment is over, the applicant returns to Canada to resume her job.
